Cookie Processing Policy

1. General provisions

1.1. This Cookie Processing Policy (hereinafter – the Policy) is one of the measures for the protection of personal data of data subjects.

1.2. Cookies are small pieces of data that are transmitted and stored on the user's device (computer, smartphone, tablet or smartwatch) when visiting the Resource. With the help of these files, the Resource can remember information about the user and their device, including storing the user's personal preferences and settings, as well as "recognising" the user and their device on subsequent visits to the Resource.

1.3. This Policy applies to users of the information resource owned by DEFIANT Limited Liability Company (224030, Republic of Belarus, Brest, 17 Internatsionalnaya St., premises No. 9-p), in particular defiant.by (including its subdomains) (hereinafter – the Resource).

1.4. Information on rights related to the processing of personal data, as well as the mechanism for their exercise, can be found in the relevant section of the Personal Data Processing Policy.

2. Why we use cookies

2.1. Cookies are processed by DEFIANT LLC for the following purposes:

2.1.1. proper functioning of the Resource (including avoiding the need to re-enter previously filled access parameters to the Resource);

2.1.2. ensuring the security of Resource users (e.g. recognition of malicious users (bots));

2.1.3. collection of analytical information in aggregate form for the assessment and further improvement of the Resource's performance;

2.1.4. creation and provision of personalised marketing and advertising materials.

2.2. DEFIANT LLC does not use cookies to identify a specific user of the Resource.

3. What information about Resource users we collect

3.1. Information obtained through the use of cookies may include:

• date and time of visit to the Resource;
• duration of the session when visiting the Resource;
• information about the Resource pages visited by the user;
• number of visits to the Resource by the user within a month;
• the URL file viewed by the user and related information;
• information about the information resource from which the user navigated to the Resource;
• information about the operating system and browser used by the user's device when visiting the Resource.

4. What categories of cookies we use

4.1. The following categories of cookies may be used on the Resource:

• technical (essential);
• targeting (analytical, advertising).

4.2. Where targeting cookies are present on the Resource, information about their processing is displayed in a banner when visiting the Resource.

4.3. Technical cookies are required for the proper functioning of the Resource, including the correct use of the features offered thereon, as well as for remembering the user's individual settings (language, etc.). These cookies do not store any information about the user that could be used for advertising (marketing) purposes or to assess their behaviour on the Resource. Such data is not transmitted to third-party analytical systems.

4.4. Targeting cookies:

• allow assessment of how users interact with the Resource, including counting the number and duration of visits to the Resource, understanding how users reached the Resource, which Resource pages they visited, etc., which helps improve the Resource's performance and make it more user-friendly;
• are used to provide users with personalised marketing and advertising materials based on their interests, as well as information about pages visited by users, including on other information resources.

5. To whom we disclose information about Resource users collected through cookies

5.1. To achieve the purposes set out in sub-clauses 2.1.3 and 2.1.4 of clause 2.1 of this Policy, DEFIANT LLC discloses information collected through targeting cookies to the following third parties:

6. Whether we carry out cross-border transfer of information collected through cookies

6.1. DEFIANT LLC, when using third-party cookies provided by the third parties specified in section 5 of this Policy, carries out cross-border transfer of data not related to the identification of a specific user.

6.2. Cross-border transfer of information from cookies is carried out to states in whose territory an adequate level of protection of the rights of personal data subjects is ensured.

6.3. In the course of operating the Google Analytics and Yandex Metrica web analytics services, DEFIANT LLC may carry out cross-border transfer of aggregated (combined into a common set of information about users by their behavioural characteristics) data not related to the identification of a specific user to the servers of Google, Inc. and Yandex LLC respectively, located in states in whose territory an adequate level of protection of the rights of personal data subjects is not ensured.

6.4. In this regard, DEFIANT LLC informs users of the existence of risks arising from the absence of an adequate level of protection of personal data in such foreign states:

• absence (fragmentation) of personal data legislation;
• absence (limitation) of rights of personal data subjects, of the operator's obligation to respond to requests of personal data subjects;
• absence of a supervisory authority for the protection of the rights of personal data subjects;
• absence (limitation) of liability measures for violations of the rights of personal data subjects;
• risk of broad access to personal data by law enforcement agencies of various countries;
• risk of unlawful means of access to personal data and their unlawful use.

7. On what legal basis we process cookies

7.1. Since DEFIANT LLC can ensure full and proper functioning of the Resource, including the security of its use, only with the help of technical cookies, this type of cookie cannot be disabled through the Resource's functionality and is processed regardless of the user's consent.

If such cookies are disabled using browser settings, DEFIANT LLC cannot guarantee the correct operation of the Resource.

7.2. With respect to targeting cookies, DEFIANT LLC offers the user to give consent to the use of cookies or to refuse their use by clicking the "Accept" or "Decline" buttons on the pop-up information banner when first visiting the Resource.

Clicking the "Accept" button constitutes the user's consent to the processing of targeting cookies. Clicking the "Decline" button constitutes a refusal to use them.

7.3. The Resource stores the user's targeting cookie processing settings for 1 (one) year. After this period, the Resource will again request the user's consent to the processing of targeting cookies by displaying the pop-up information banner.

8. Disabling cookies in browser settings

8.1. Most browsers are set by default to accept cookies. The user may delete previously saved cookies by selecting the appropriate option in the browser history. In addition, some browsers allow visiting sites in "incognito" mode to limit the amount of information stored on the computer and automatically delete certain types of cookies.
